2nd Floor Review Procedure

1. Complete the Motion and Order: found here

2. Upon obtaining the Judge’s signature GRANTING your motion, please follow-up to confirm service on the Sheriff

a. Chief Monfra must be served for the 2nd floor review transport

b. The jail may contact you to modify this date/time if the rooms have already been scheduled for the selected date/time

3. Enrolled Defense counsel appear on the 2nd floor for the date and time of your Order or date and time as agreed between counsel and JPCC

4. Counsel shall provide all equipment necessary for defendant to review the discovery

5. Counsel shall remain present for the entirety of the viewing process

IMPORTANT NOTES:

Please file the motion allowing time for the Judge to review and sign same, and service to be issued to Chief Monfra at least two weeks in advance of your desired date/time for viewing.

Make sure your phone number is accurate in the event the jail needs to contact you.

4th Floor Division M Procedure

1.      Complete the Motion and Order: found here

2.      Upon obtaining Judge’s signature granting the motion, Division Minute Clerk is to enter all information here

a.      Defense Attorney will receive an e-mail when their Motion has been GRANTED and the viewing is scheduled

b.      Cancellation Link – Should you need to cancel your time, the link can be found at the bottom of your confirmation link, or here

3.      Defense Counsel - Appear in Division M* on the 4th floor on the scheduled date promptly for 1:00 p.m.

a.      Counsel shall provide the device for viewing as well as any apparatus needed to enable the defendant to hear the audio

b.      Because more than one defendant may be present during the review, Defense counsel is responsible for providing the audio equipment, and it shall not be played out loud if more than one defendant is present, unless all defendants present are co-defendants there for the purpose of viewing the same footage.

c.      Enrolled counsel must remain present in the courtroom

d.      All discovery review will conclude at 3:00 p.m.  In the event the review is not complete, or unable to be completed in the allotted two hours, you may file motions for multiple Fridays.

e.      If you know your discovery cannot be viewed entirely in the allotted time, you may file multiple motions in advance, and do not need to wait to complete one review before filing for a subsequent review.  

 

IMPORTANT NOTES:

Please file the motion allowing time for the Judge to review and sign same, and the Clerk to complete the form to JPCC such that JPCC is notified at least 72 hours prior to the desired review date and time.  Failure to allow for such time may result in the Motion being denied by the court, or the defendant not being transported.
